Privacy Protection Rules
Atlantic Grand d.o.o. (hereinafter: the Company or we) is part of the Atlantic Group business system, within which high standards of corporate governance and transparent business operations have been established and are applied, implying responsible, lawful and ethically grounded conduct by all legal entities of Atlantic Group, including respect for privacy and personal data protection.
Guided by the above standards, the Company, as the controller within the Atlantic Group business system, collects and processes personal data lawfully, fairly and transparently in accordance with applicable regulations and by taking appropriate technical and organizational measures aimed at protecting personal data from unauthorized access and misuse.
The Company is aware that personal data protection is important to our users and data subjects. Therefore, we want to show you what personal data we collect, how we manage it and how we take care of its protection.
Purposes, scope and legal basis of processing
Personal data are collected for specific, explicit and lawful purposes, to the extent necessary, and are processed in a manner consistent with those purposes.
The Company will collect and process personal data only in cases permitted by law:
- processing is necessary for compliance with legal obligations;
- when the data subject has given consent to the processing of their data;
- processing is necessary for the performance of a contract to which the data subject is a party or in order to take steps at the request of the data subject prior to entering into a contract;
- processing is necessary to protect the vital interests of the data subject or another natural person;
- processing is necessary for the purposes of the legitimate interests of the Company or affiliated companies.
Collection and use of personal data
Personal data are information that identify you directly or indirectly, such as your name, email address, phone number, IP address or postal address.
The Company does not collect your personal data unless you explicitly provide such data (e.g. by making an inquiry about a specific product or service, concluding a contract or requesting certain actions before concluding a contract, joining loyalty programs, subscribing to an electronic newsletter, participating in surveys, competitions and prize games, ordering samples or brochures, requests for donations, as well as when requesting information, submitting a CV or open application or applying for open positions, or being employed by our company...).
We collect, store, use or transfer your personal data to the extent - in terms of content and duration - required in a particular case, e.g. in order to respond to your inquiries, fulfill your requests, inform you about our products, competition or prize game results, perform contractual obligations or necessary pre-contractual actions, or fulfill other legal or regulatory obligations. For these reasons, the Company sometimes needs to transfer data to other companies within Atlantic Group and affiliated companies or to external service providers for further processing. Service providers, i.e. processors of personal data, may be engaged, for example, in the context of call center services, goods delivery, distribution of promotional materials, or the organization and execution of prize games. The Company requires these parties to comply with applicable legal regulations, to follow our instructions, and to comply with our internal personal data protection rules, as well as with the requirements for applying appropriate organizational and technical protection measures. For the same reasons, your personal data may sometimes need to be transferred to EU countries or outside the EU, whereby the Company ensures that such transfer is fully in compliance with the law and applicable regulations, applying all available and appropriate personal data protection measures.
The Company guarantees that your personal data will not be sold to anyone, and that it will not forward or lend your personal data to any third party unless this is necessary to fulfill the specific purpose for which you provided it to us, and guarantees that your data will not be given to any unauthorized recipient.
It is possible that we may need to provide your personal data to the competent public authority if required by law or another binding regulation.
Collected data will be kept for as long as necessary, considering the purpose for which they were collected, i.e. within the period in accordance with applicable regulations.
Use of personal data for advertising and marketing purposes
When your personal data are used for advertising and marketing purposes in accordance with applicable legal regulations in the field of personal data protection, your data will be stored and used for those purposes, e.g. for sending newsletters, product samples, invitations to participate in competitions and prize games, via email or post or another communication channel you have accepted.
If your personal data will be used for sending individual (personalized) advertisements and promotions through the creation and maintenance of a user profile, you will be informed in advance, i.e. before such advertisements and promotions are sent, and we will certainly ask you for separate, explicit and informed consent before such data processing.
As needed, we will use your data to analyze and improve the efficiency of our online services, advertising, marketing, market research and sales efforts, through surveys or other inquiries, or in a way that ensures your personal data are anonymized, i.e. cannot be linked to an individual.
Exercising the rights of data subjects
At any time, you may request information from us about your personal data that we process or request its correction, you may request cessation of use or deletion of your personal data or withdrawal of consent for all or only some purposes (except where this is not possible, e.g. if the data are processed for statistical purposes and no longer allow identification), as well as data transfer to another processor under legal conditions or unsubscribe from receiving our informational and promotional materials.
You may also object to the use of your personal data in situations based on our legitimate interest, and certainly when we use them for direct marketing purposes.
On our part, to the maximum extent reasonably possible, we will ensure that your personal data that you have made available to us are correctly recorded, but responsibility for their accuracy lies with you, and we kindly ask you to update them regularly and promptly, or submit a request for change or correction.
To exercise all your rights and obligations regarding the use of personal data, you may contact the email address or registered office address of the Company listed on the website, or the email address: dpo@atlanticgrupa.com or follow the instructions on the provided promotional materials.
When contacting us and submitting the above requests, we will make reasonable efforts to verify your identity and prevent unauthorized processing of personal data.
Upon receipt of your requests, we will carry out the requested activity within a certain period, and no later than 30 days from receipt of the request, and we will inform you about it if necessary, all in accordance with the law.
Minors
As a rule, we do not collect personal data of minors. If such data are transferred to us without the consent of parents or legal guardians, we will delete them as soon as possible. In doing so, we will follow the instructions we receive from you as a parent or legal guardian.
If, for any purpose, we do collect personal data of minors at an age when parental consent is required under applicable law for the processing of their personal data, we will provide appropriate information and apply reasonable measures to verify that minors have the consent of a parent or legal guardian.
Data security
We have implemented technical and organizational measures to prevent loss of your data, alteration, theft or access by unauthorized third parties, i.e. any unauthorized processing. Access to your personal data is limited only to those employees who need such information in providing our services, i.e. resolving your inquiry. We continuously educate our employees about the importance of data confidentiality and the protection of your privacy and data. We collect only the data necessary for the relevant processing and do not store them longer than necessary, i.e. as determined by legal regulations.
On our website, you may sometimes find links to other websites or portals, and we may also offer you social media functions that enable sharing personal data on social networks. We recommend that you familiarize yourself in advance with the personal data protection rules of those portals or social networks or third parties, as well as their security measures, since they may differ from these rules and the measures we have taken, for which we bear no responsibility.
Limitation of liability
Although we take available technical, organizational and personnel measures to protect personal data from accidental or intentional misuse, destruction, loss, unauthorized alteration or viewing, we cannot guarantee that some of the data we collect will never be accidentally disclosed, contrary to the provisions of these privacy rules.
To the maximum extent permitted by law, we exclude liability for damage caused to users or third parties by accidental disclosure of personal data.
Since we have no control over the personal data you provide when accessing or using other portals, or directly to third parties (e.g. when participating in sponsored activities), to the maximum extent permitted by law we exclude liability for damage that may arise to you or third parties due to the provision of personal data.
